Ex-MP Ngawaiya charged of owning unregistered firm

 

FORMER Moshi Rural Member of Parliament (MP), Thomas Ngawaiya, yesterday appeared before the Kisutu Resident Magistrate’s Court in Dar es Salaam charged with engaging an unregistered firm to undertake construction works into a hotel building valued at 500m/-.

Ngawaiya, a businessman and former MP on the ticket of the Tanzania Labour Party (TLP) before he defected to the ruling Chama Cha Mapinduzi (CCM), denied the charge.

He is alleged to have committed the offence contrary to the Contractors Registration Act. Senior Resident Magistrate Hellen Riwa, who conducted the proceedings, granted the accused bail on conditions of securing two reliable sureties, who were required to sign a bond of 250m/- each.

One of the sureties, according to the magistrate, was to surrender a title deed of immovable title certified at the said amount. However, only one surety showed up to bail out the politician-cum businessman.

The magistrate, however, approved bail to the accused person after tasking the surety who had responded and the advocate for Ngawaiya to look for another surety who should attend the next court session scheduled for April 21.

A public prosecutor from the Contractors Registration Board, Mr Saddy Kambona, informed the court that investigations into the matter have not been completed.

The magistrate adjourned the case pending further investigations. It is alleged that Ngawaiya committed the offence on March 24, last year, at Plot Number 32 along Dosi and Wazani Street at Magomeni Mapipa in Kinondoni District in the city. He allegedly engaged unregistered persons to undertake the construction works at the hotel valued at 500m/-.

The prosecution claimed that the case against Ngawaiya was filed before the court since last year.

The court issued summonses requiring him to enter appearance to answer the charge, but refused to respond. The prosecution had to use harsh means of arresting him.
